Terms of Service
1. Acceptance of Terms
By using TownCloud Broadcast’s messaging service (“Service”), you agree to these Terms. If you do not agree, do not subscribe or send messages.
2. Service Overview
TownCloud Broadcast enables municipalities (“Municipal Users”) to send official, non-marketing Email and/or SMS notifications to subscribers (“Subscribers”). Subscribers receive messages only from the municipality they explicitly opt into.
3. Eligibility & Registration
Subscribers:
- Must be ≥ 13 years old.
- Provide a valid Full Name.
- Provide an Email address if choosing “Email only” or “Both.”
- Provide a Phone number if choosing “SMS only” or “Both.”
Municipal Users:
- Must represent a recognized municipality or official body.
- Provide proof of authority (e.g., official email domain).
4. Subscriber Obligations
- Provide accurate contact information and choose your preferred method(s).
- Do not subscribe using someone else’s email or number.
- Follow opt-out instructions: “unsubscribe” link for Email or reply “STOP” for SMS.
5. Municipal User Obligations
- Use the Service only for official, non-marketing notifications (e.g., emergency alerts, community updates).
- Confirm each subscriber’s opt-in before sending messages.
- Comply with applicable laws (e.g., TCPA, CTIA, and Twilio 10DLC guidelines).
- Maintain and display a valid Privacy Policy and Terms of Service on a live website.
6. Prohibited Conduct
- Sending unsolicited marketing or promotional content.
- Sharing or selling subscriber email addresses or phone numbers.
- Using the Service for illegal, harassing, or fraudulent activities.
7. Intellectual Property
All platform content, trademarks, and software belong to TownCloud Broadcast or its licensors. Municipal Users may not copy, modify, or redistribute our platform or branding without written permission.
8. Disclaimers & Limitation of Liability
Service Availability:
We aim for high uptime but do not guarantee uninterrupted service. We are not responsible for carrier outages, internet failures, or force majeure events.
No Warranty:
The Service is provided “as is.” We disclaim all warranties, including merchantability and fitness for a particular purpose.
Liability Cap:
Our total liability for damages arising under these Terms is limited to $100 or the total fees paid in the last 12 months, whichever is lower. We are not liable for indirect, incidental, or consequential damages.
9. Termination
We may suspend or terminate any Subscriber or Municipal User account if these Terms are violated or at our discretion. Upon termination, you must stop using the Service immediately.
10. Governing Law & Dispute Resolution
These Terms are governed by Colorado law, without regard to conflict-of-law principles. Any disputes must be filed in state or federal court in Denver County, Colorado.
11. Modifications
We may modify these Terms. Updated versions will be posted with a “Last Updated” date. Continued use of the Service after changes constitutes acceptance.

Privacy Policy
1. Introduction
TownCloud Broadcast (“we,” “us,” “our”) provides an opt-in messaging service for municipalities to send official notifications. This Privacy Policy explains how we collect, use, and protect your information.
2. Information We Collect
- Full Name: Required for identification.
- Email Address: Required if you choose “Email only” or “Both.” Used to send official, non-marketing messages.
- Phone Number: Required if you choose “SMS only” or “Both.” Used to send official, non-marketing SMS.
- Communication Preference: Tracks whether you opted into Email, SMS, or both.
- Automatically Collected Data: IP address, browser/device type, and timestamp (for security, analytics, and troubleshooting).
3. How We Use Your Information
Messaging:
- Email addresses are used solely for sending official municipality notifications.
- Phone numbers are used solely for sending official SMS notifications.
Account Management:
If you register on our site, we use your email/password to authenticate and manage your account.
Security & Analytics:
We analyze IP and device data to detect abuse, monitor performance, and improve the service.
4. Data Sharing & Disclosure
- We do not sell, rent, or share your personal information with third-party marketers.
- We may share aggregated, anonymized statistics (e.g., subscriber counts) for operational insights—no personal identifiers included.
- We may disclose data if required by law or to prevent fraud or abuse.
5. Opt-In & Opt-Out
- Opt-In: You explicitly choose Email, SMS, or both.
- Opt-Out (Email): Click the “unsubscribe” link in any email.
- Opt-Out (SMS): Reply “STOP” to any SMS.
Once opted out, you will no longer receive messages unless you opt in again.
6. Data Security
- We use standard encryption (HTTPS/TLS) in transit and encrypted storage at rest.
- Access to personal information is limited to authorized personnel only.
7. Data Retention
- We keep your name, email, phone, and preference as long as you remain an active subscriber or until you request deletion.
- If you opt out or request deletion, we will remove your data within 30 days, except for anonymized logs.
8. Children’s Privacy
Our service is for users aged 13 and over. We do not knowingly collect information from anyone under 13. If you believe we have, contact us immediately.
9. Policy Updates
We may update this policy. New versions will display a “Last Updated” date and be posted on our website. Significant changes will be communicated to active subscribers.
